CORN
PALACE RENTAL POLICY
BOOKING OF CORN PALACE RESPONSIBILITY: The functional responsibility of fee usage and
scheduling of the Corn Palace governmental and
non-governmental persons and entities is under
the direction and management of the City of
Mitchell Corn Palace Director. This functional
responsibility will be operated through the
framework of this policy and further direction
of the Mayor and/or the Mitchell City Council.
The Corn Palace Director, subject to the further
direction of the Mayor and/or the City Council,
will determine any matter or issue not covered
by this policy.
BOOKING REQUIREMENTS: All persons and organizations desiring to use
the Corn Palace shall be required to enter into
a written contract in the form required by the
City of Mitchell for such purposes. Booking
dates will not be confirmed until the City of
Mitchell/Corn Palace Office has received the
signed contract with the required deposit. No
person or entity shall have any vested right to
the use of the Corn Palace for any purpose, and
the Corn Palace Director has discretion to
decline a contract for any requested use of the
Corn Palace with any person for any reason
deemed legitimate and/or appropriate by the Corn
Palace Director, in his/her sole discretion,
subject only to the direction of the Mayor
and/or the Mitchell City Council.
BOOKING RESERVATIONS:
The contracts of the City with Dakota Wesleyan
University, Mitchell Christian School and the joint
use agreement with the Mitchell Public Schools
relating to the use of the Corn Palace shall have
priority over non-annual events. Other bookings will
generally be made on a first come priority basis,
with the exception that in no event will bookings be
made which conflict with annually held events. In
the case of scheduling conflicts of basketball
games, priorities are in the following order:
Mitchell Public Schools, Dakota Wesleyan University,
and Mitchell Christian School. All bookings are
subject to the right of acceptance and refusal by
the City of Mitchell.
Access to the Corn Palace open for the purpose
of decorating, set up (other than the setting up
of tables, chairs and other Corn Palace
equipment) and rehearsals will be scheduled with
the Corn Palace Director, and be subject to the
direction of the Corn Palace Director.
USER FEE: The user fees for use of the Corn Palace shall
be in conformance with the
schedule of fees from
time to time in effect, and listed on a separate
schedule of fees. User fees, are payable in
advance to the Corn Palace Office not later than
the date of reserved usage, unless other
arrangement for payment is made with the Corn
Palace Director.
DEPOSIT: As a condition of reserving a date for use of
the Corn Palace, each User shall make a deposit
of
Twenty-five percent (25%) of the user fee which
shall be paid with the signing of the contract.
In the event that the User shall find it
necessary to request cancellation of its
reservation, such cancellation must be submitted
to the Corn Palace Director in writing no later
than ten (10) days prior to User's scheduled use
of the Corn Palace. If Corn Palace Director is
notified of said cancellation in writing within
ten (10) days prior to User's scheduled use of
the Corn Palace, the City of Mitchell will
refund the twenty-five percent (25%) deposit
made by User to the City of Mitchell. If User
fails to notify the Corn Palace Director in
writing less than ten (10) days prior to its
scheduled use of the Corn Palace, User does
hereby agree to and does forfeit the twenty-five
percent (25%) deposit previously made to the
City of Mitchell. Use contracts with schools
shall be exempt from the advance deposit
requirement.
FIXED FACILITIES: The User shall be entitled to the use of the
Corn Palace fixed facilities, including floor
coverings, tables and chairs at no extra charge.
This does not include the use of the sound
system or other equipment or wages paid to the
union personnel. There shall be no exception to
the a forestated rental schedule without the
specific approval of the City of Mitchell.
Fixed facilities shall mean heat, air
conditioning, house lights, dressing rooms,
shower facilities, fixed seating and the ticket
office when required and available. Any User of
the Corn Palace who requires other equipment not
designated as fixed facilities shall make
arrangements with the Corn Palace Director prior
to the event and will pay the extra charges as
determined by the City of Mitchell.
BANQUETS: Catered food may be served in the Corn Palace.
No cooking or other food preparation is allowed
in the Corn Palace. No washing of utensils or
food equipment is allowed in the Corn Palace.
Equipment used for keeping food warm, which
requires outlets, will be allowed, subject to
approval by the Corn Palace Director.
ALCOHOLIC BEVERAGES: No alcoholic beverage may be served or consumed
in the Corn Palace without the express consent
of the Mitchell City Council. The City may
license the serving of alcoholic beverages or
malt beverages for events and under
circumstances deemed appropriate by the Mitchell

licensing in the Corn Palace.
SECURITY/CROWD CONTROL: All Users of the Corn Palace will provide proof
of adequate crowd control and/or police
protection as a condition of the use and
occupancy thereof, unless other arrangements
have been made through the Corn Palace Director.
Adequate crowd control and/or police protection
shall be stationed so as to have full control
over all areas of the Corn Palace, both used and
unused. Crowd control measures shall be
implemented and maintained beginning no less
than one-half hour prior to the use and opening
of the Corn Palace and shall continue until all
spectators and other persons have left the
premises at the end of the usage.

BONDING AND INSURANCE REQUIREMENTS: When deemed required by the Corn Palace
Director, bonding requirements imposed upon the
user shall be determined by the City Council of
the City of Mitchell, South Dakota.
Each User shall maintain occurrence based
commercial general liability insurance or
equivalent form, with a limit of not less than
$1,000,000 each occurrence. Such insurance shall
include the following:
The LESSEE shall
indemnify and hold harmless the City
of Mitchell and its agents, employees and
volunteers from and against all claims,
damages, losses and expenses, including but
not limited to attorney's fees, arising out
of or resulting from (i) the conduct or
management of the premises or of any
business therein, (ii) any act, omission, or
negligence of the LESSEE or the partners,
directors, officers, agents, employees,
invitees or contractors of the LESSEE (iii)
any accident, injury or damage whatsoever
occurring in or at the premises. LESSEE
hereby expressly indemnifies the City of
Mitchell its agents, employees, and
volunteers, unless such act of omission
constitutes gross negligence or intentional
misconduct.
LESSEE shall maintain occurrence based
Commercial General Liability Insurance or
equivalent form with a limit of not less
than $1,000,000.00 each occurrence. If such
insurance contains a general aggregate
limit, it shall apply separately to this
agreement or be no less than two times the
occurrence limit. Such insurance shall
add
the City of Mitchell, South Dakota and its
employees and volunteers as
additional insured's. Any Lessee
providing or allowing alcoholic beverages in
the Corn Palace must carry
Liquor Liability insurance for no
less than $500,000.00 adding the City of
Mitchell as
additional insured's.
UNION PERSONNEL: Each User of the Corn Palace who requires
operation of any equipment subject to union
rules must arrange for equipment operators under
the union people. The City of Mitchell has no
jurisdiction or control over union personnel
charges and wages. All charges and wages for
union personnel will be determined between the
union personnel and the User. For information

The stated rates for union personnel as of the
time of the publication of this policy are as
follows:
Stagehands: $17.00 per hour (anything after
Midnight, Sundays or Holidays: $25.50 per hour
plus $55.00 per person per show).
The forgoing rate information is provided on an
advisory basis only, and is subject to change.
OTHER FEES AND CHARGES:

The User shall
pay to the City of Mitchell a twenty percent
(20%) commission of gross sales on
merchandise sales (T-shirts, tapes, CD's,
etc.). The User is responsible to sell the
merchandise and will provide a count of all
merchandise to the Corn Palace Director.

The User or
licensed provider shall pay to the City of
Mitchell a twenty-five percent (25%)
commission of gross sales on alcohol sales.
The User is responsible to obtain a valid
malt beverage or liquor license to sell
within the premises. The User is responsible
to provide acceptable staff, as deemed by
the Mitchell City Council, the Mitchell
Police Department and the Corn Palace
Director, for the sale of alcohol. The User
will provide a count of all sales to the
Corn Palace Director.

The User shall
pay to the SD Department of Revenue seven
percent (7%) on merchandise and ticket
sales. User must have South Dakota sales tax
license and provide proof of the same to the
Corn Palace Director as a condition
precedent to any such sales.

The User shall
pay a change of venue fee up to the sum of
$1,000.00 for converting the Corn Palace
arena into a different set-up (if
applicable).

The User shall
pay for a scoreboard operator a fee in the
sum $20.00 (if necessary).

The User shall
be responsible for paying license fee for
events where any music is played, i.e.
bands, background music, concerts, etc., to
BMI, ASCAP and SESAC. The charges are based
on ticket price, number of seats available
and gross ticket sales.

The User shall
pay a fee for Box Office Staffing upon
request, as follows:
